By paying the initial payment, the tenant is agreeing to comply with the terms of this contract below.
MINIMUM AGE REQUIREMENT IS 25 TO BOOK
LIABILITY: When accepting this agreement, tenant/ guest agrees to assume all liability and hold the landlord, property owners, and their family members harmless from responsibility for any and all injuries/death to persons or damage to property caused by the vacationer, the group or to any guests while on the premises with vacationer’s permission. Vacationer agrees to pay any cost and attorney fees incurred by owner in defending any lawsuit or other action brought in reference to any injuries or damage to vacationers, guests, or family. All vacationers’ personal property inside and outside the premises is at vacationers’ risk only and owner shall not be liable for any damage to it, nor is owner responsible for ensuring security and safeguarding of vacationer’s personal property, automobile or valuables.
NOISE ORDINANCES: This is a residential area and excessive outdoor noise will not be tolerated. Any violation or complaint with respect to a noise violation will forfeit the security deposit and possible immediate termination of the rental agreement.
PARKING SPACES: This property has room for 4 cars to be parked inside property . All cars must be parked on the property at all times. The city will tow all illegally parked vehicles at the guest’s expense. No cars shall be parked on the street at any time or security deposit will be forfeited.
PET UNDER 20 LBS ALLOWED NO CATS, PLEASE CLEAN UP AFTER YOUR PET.
LIVING IN THE TROPICS: When accepting this agreement, the tenants confirm that they understand that the home is in a tropical and hot weather location and that occasional wildlife and insects not ordinarily seen in other climates may be on property. Our properties are on a regular pest prevention and control program to mitigate their presence, however, we cannot guarantee that pests will not find their way in from time to time. If you see a pest, please let us know so that we can have the pest control company do an additional treatment if needed. Being in Florida’s tropical climate means that pests are something that are dealt with often, and there is no way to 100% guarantee that they will stay outside. Tenants also understand that the weather is unpredictable and owners will not refund rents due to inclement weather.
NO SMOKING: Due to allergies of and the safety of our guests, there is NO SMOKING allowed in the house. Please use an outdoors ashtray. If evidence of smoking on the property is found, we will retain your entire security deposit. Smoke outside and leave no evidence (cigarette butts, etc.).
SWIMMING POOL AND WATER SAFETY: When accepting this agreement, the tenants confirms that they understand that NO LIFE GUARD WILL BE ON DUTY and POOLS AND OPEN WATERWAYS IN CANALS ARE DANGEROUS. Guests understand that injuries and death by drowning is a very real threat. Tenant agrees to hold harmless property owners if any accident around or in the pool or canal should occur. Access to the pool equipment has been locked for the safety of the guests. The pool and the grounds are maintained by the owner a weekly basis. All efforts will be made to arrange maintenance visits during weekdays Monday to Fridays between 9 am - 5pm to minimize guests inconvenience, but it may necessary to access the property on weekends.
NO DRUGS ARE ALLOWED: This property is a no drug zone and the presence of drugs on this property will be reason to forfeit 100% of your security deposit and you will be immediately asked to vacate the property without a refund.
TRASH HANDLING AND CONTAINMENT: The vacationer agrees to use the trash containers provided and bring filled trash containers to the curb no earlier than 6 pm the evening prior to solid waste pick up and bring the containers back to the side of the house before 12 midnight of the day of pick up. The Black bins are for general garbage and the Blue bins are for Recyclables. The Green bins are for landscape debris ONLY. DO NOT USE the Green Bins. Garbage pick up is:
a. Monday morning: Black bins pickup
b. Thursday morning: Black and Blue bin pickup
CHECK OUT AND LEFT BEHIND ITEMS: Since the property needs to be cleaned and sanitized by 3 PM for the next vacationer, the vacationer understands that this rental term expires at 11 am on the last day of your stay. The vacationer agrees to check out, remove all vacationers’ possessions and vacate the property at or prior to 11AM unless specific permission by owner is given. Items left behind may be returned to vacationer by freight collect or disposed of at the discretion of the owner. A deduction of $200 will be taken from the Security Deposit if the property is not vacated before the 11 AM check out time thereby not allowing the cleaning team to get in and do their jobs. There will be an additional cleaning fee charged if a deeper cleaning is required as determined by the owner inspection once vacated.
PROPERTY DAMAGE: While you are renting the house, you are responsible for missing items or damage caused by you, your family, your pets , your guests and visitors. There is a $1,500 damage deposit that will be returned once the property is inspected and everything is as the way it was at check in. All furniture must be returned to its original location on Guest's departure or an additional charge will be made.
LAW ENFORCEMENT: If the police are called due to loud noise or disturbing the peace, you will be asked to leave, your entire security deposit will be withheld and your remaining nights will not be refunded.
It is unlawful for a sexual offender to occupy this residence.
